NOTICE OF TRUSTEE'S SALE

The real property described below and situated in Wasatch County, Utah (the “Property”) will be sold at public auction to the highest bidder, payable in lawful money of the United States at the time of sale, at the front entrance of the Fourth Judicial District Courthouse for Wasatch County, 1361 South Highway 40, Heber City, Utah 84032 on September 1, 2010 at the hour of 11:00 a.m. The sale is for the purpose of foreclosing the delinquent assessment lien (the “Assessment Lien”) owing to the Jordanelle Special Service District, Utah Special Improvement District No. 2005-2 (the “District”) for the Property with the title vested in the name of BV Jordanelle, LLC, a Utah limited liability company. The Assessment Lien arises from the Assessment Ordinance referenced in the Notice of Assessment Interest recorded against the Property on September 24, 2009 as Entry No. 352632 in Book 1000 at Pages 1569-1583 in the Official Records of the County Recorder of Wasatch County, Utah. W. Jeffery Fillmore has been appointed the Foreclosure Trustee to foreclose the delinquent Assessment Lien. The Property is vacant land and does not have an assigned address and is situated in Wasatch County, Utah as more particularly described on Exhibit “A” attached hereto together with all improvements, easements, rights, appurtenances, rents, royalties, mineral, oil and gas rights and profits, water rights and stock and all fixtures.
The current owner of the Assessment Interest and the Assessment Lien is the District and the record owner of the Property as of the recording of the Notice of Default and Election to Sell is BV Jordanelle, LLC.
The Trustee's sale of the Property will be made without covenant or warranty, express or implied, regarding title, possession or encumbrances.

Bidders must tender a $10,000 deposit to the Successor Trustee at the time of sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a cashier's check or bank official check payable to Jordanelle Special Service District. The balance must be in the form of a wire transfer or a cashier's check drawn on a bank acceptable to the District (credit union checks are not accepted) payable to Jordanelle Special Service District. Cash Payments are not accepted. A trustee's deed will be delivered to the successful bidder within three business days after receipt of the amount bid.

The purpose of this notice is to collect a debt and any information obtained may be used for that purpose.

Legal Description

The North Half of Southeast Quarter of Section 2, Township 3 South, Range 5 East, Salt Lake Base and Meridian.

The Southwest Quarter of Section 2, South Half of the Southeast Quarter of Section 2, all of the forgoing in Township 3 South, Range 5 East, Salt Lake Base and Meridian.

The East Half of Section 3, Township 3 South, Range 5 East, Salt Lake Base and Meridian.

Subject to a 30 foot wide access easement, said easement is 15 feet on both sides of the following described centerline:

Beginning at the intersection of the Southerly right of way line of said State Highway 32 and a line which is offset 15 feet to the East and parallel with the West line of Lot 1 of Section 3, Township 3 South, Range 5 East, Salt Lake Base and Meridian; thence running South and parallel with said West line of Lot 1, and the prolongation thereof to a point which is 15 feet South of the North line of the Southeast Quarter of Section 3 to the East boundary of the Northwest Quarter of the Northwest Quarter of the Southeast Quarter of said Section 3.

The Northwest quarter of the Northeast quarter of Section 2; North half of the Southwest quarter of the Northeast quarter of Section 2, all of the forgoing in Township 3 South, Range 5 East, Salt Lake Base and Meridian; and

The parcel known as Talisman Subdivision, Phase 1, according to the official plat thereof on file and of record in the Wasatch County Recorder's Office, and
