NO. CO-10-11
AN ORDINANCE OF MORGAN COUNTY AMENDING VARIOUS SECTIONS OF THE MORGAN COUNTY CODE REPEALING ALL REFERENCES TO PLANNED RESIDENTIAL UNIT DEVELOPMENTS
WHEREAS, the County Council previously repealed the Planned Unit Development Overlay District by adopting Ordinance 05-11 on February 17, 2006, AND Ordinance 10-11 on June 15, 2010;and
WHEREAS, similar concerns and issues have caused the Planned Residential Unity Development (PRUD) provisions within the Morgan county Code to be similarly considered and reviewed; and
WHEREAS, the Planning Commission has reviewed and made a recommendation to the County Council concerning the proposed text amendments to the Morgan County Code, and the County Council has found the proposed changes to be consistent with the County’s General Plan and in the public interest; and
WHEREAS, the proposed text changes set forth herein have been reviewed by the Planning Commission and the County Council, and all appropriate public hearings have been held in accordance with Utah law to obtain public input regarding the proposed revisions to the Morgan County Code.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNTY COUNCIL OF MORGAN COUNTY, STATE OF UTAH, AS FOLLOWS:
Section 1. Amendment The Morgan County Code is hereby amended to read as set forth in Exhibit ‘A’.
Section 2. Severability If any section, sentence, clause, phrase or word of this ordinance is for any reason held or declared to be unconstitutional, inoperative, or void, such holding or invalidity shall not affect the remainder thereof and it shall be construed to have been the legislative intent to pass this ordinance without such unconstitutional, invalid or inoperative part thereon. The remainder of this ordinance, after exclusion of such part or parts, shall be deemed and held to be valid as if such part or parts had not been included therein.
Section 3. Effective Date This Ordinance shall become effective after subsequent publication in accordance with State Law, but not before 15 days after its passage.
