NOTICE OF TRUSTEE'S SALE
The following described real property will be sold at public auction to the highest bidder, payable in lawful money of the United States, at the front entrance of the Third District Courthouse, Summit County, 6300 North Silver Creek Dr., Park City, Utah 84098, on August 3, 2010, at 11:00 a.m. of said day, for the purpose of foreclosing a “Deed of Trust” originally executed by Brian Kitts, as Trustor, in favor of Winterfox, LLC, dated December 8, 2004, and recorded December 10, 2004, as Entry No. 00719546, in Book 1665, at Page 01806, in the Official Records of Summit County, Utah (the “Deed of Trust”), covering the real property located at and commonly known as 2580 Bear Hollow Drive, Park City, UT 84098, and more particularly described as follows (the “Trust Property”):
Lot 25, Cedar Draw Estates Subdivision, according to the official plat on file in the Summit County Recorder's Office
The following is shown for information purposes only: Parcel I.D. No. CDE-25
Said Trust Property will be sold without warranty as to title, possession, or encumbrances, and will be subject to all prior liens and encumbrances.
Bidders must tender to the trustee a $5,000.00 deposit at the sale, and the balance of the purchase price must be paid by 12:00 noon the day after the sale. Both the deposit and the balance must be by cashier's check or certified check payable to Fabian & Clendenin, P.C.
The current beneficiary of the Deed of Trust is Winterfox, LLC and the record owner of the property as of the recording of the Notice of Default was Brian Kitts.
