The following described property will be sold at public auction to the highest bidder, without warranty as to title, possession or encumbrances, payable in lawful money of the United States at the time of sale, at the front door of the First
Judicial District Courthouse, 135 North 100 West, Logan, Cache County, Utah, on Tuesday, September 12, 2017, at 10:00 am of said day, for the purpose of foreclosing a Deed of Trust executed by CARLOS MARTINEZ as Trustor, in
favor of SCOTT M. LYMAN as Beneficiary, which Deed of Trust was recorded on October 30, 2009 in Book 1597 at Page 539 as Entry No. 1009809 in the office of the Recorder of Cache County, Utah. The original Beneficiary, SCOTT M. LYMAN, assigned his beneficial right, title and interest in said Trust Deed to RICHMOND CITY, a Utah Municipal
Corporation, by Assignment of Trust Deed dated July 26, 2016 and recorded on July 26, 2016 in Book 1907 at Page 782 as Entry No. 1152199 in the office of the Recorder of Cache County, Utah, covering real property located in Cache County, Utah, and more particularly described as follows: A tract of land in fee being in Block 19, Plat A of the Richmond City Survey situate in the Northwest Quarter of the
Southwest Quarter of Section 26, Township 14 North, Range 1 East, Salt Lake Base and Meridian. The boundaries of said tract of land are described as follows: Beginning in the
westerly boundary line of said entire tract at a point which is 16.574 feet South from the Northwest corner of said Block 19; and running thence South 61.43 feet along the east
right-of-way and limited access line of SR-91 designated as point \"C\"; thence South 30.00 feet along the east right-of-way and limited access line of said SR-91 designated as point \"D\"; thence South 17.00 feet along the east right-of-way and limited access line of said SR-91 to the Southwest corner of said tract; thence East 100 feet along the south boundary line of said entire tract; thence North 125.00 feet along east boundary of said tract to the south right-of-way line of Main Street to a point designated as point \"A\"; thence West 30.00 feet along the south right-of-way line of Main Street to a point designated as point \"B\", thence West 57.445 feet along the said south right-of-way line of Main Street; thence
Southwesterly 21.034 feet along the arc of a 40.00 foot
radius curve to the left (Note: Chord bears South 37 08\' 38\" West 20.792 feet) to the east right-of-way and limited access line of said SR-91 to the point of beginning.The above
described tract of land is granted with limited access as shown in the office of the Recorder of Cache County, Utah and as further described in the Deed of Trust and Notice of Default, referenced hereafter. Tax Roll No. 09-058-0015

Together with all buildings, fixtures and improvements
thereon and all water rights, rights of way, easements, rents, issues, profits, income, tenements, hereditaments, privileges and appurtenances thereunto belonging, now or hereafter used or enjoyed with said property, or any part thereof
(hereafter collectively Real Estate).Property Address: 11 South 200 West, Richmond, Utah 84333. The current
beneficiary of the Trust Deed is RICHMOND CITY and the record owner of the property as of the recording of the Notice of Default on May 12, 2017 as Filing No. 1171657 in Book 1950 at Page 1550 in the office of the Recorder of Cache County, Utah is CARLOS MARTINEZ.The purchase price is payable in lawful money of the United States of America.
Bidders must be prepared to tender to the Trustee a $5,000.00 non-refundable deposit in cashier\'s check or
certified funds at the time of sale to secure bid, and the
balance of the purchase price must be paid in full in the form of a wire transfer, cashier\'s check or certified funds within 24 hours from the time of sale.

The sale is subject to a bankruptcy filing, a payoff, a
reinstatement of any other condition of which the Trustee is not aware that would cause the cancellation of this sale.
Further, if any of these conditions exist, the sale will be null and void, the successful bidder\'s funds shall be returned and the Trustee and Beneficiary shall not be liable to the
