NOTICE OF TRUSTEE’S SALE
The following described property will be sold at public auction to the highest bidder, payable in lawful money of the United States of America at the time and in the manner set forth below, such public auction to be held at the main entrance of the Second Judicial District Court, Davis County, Bountiful, located at 805 South Main Street, Bountiful, Utah, on August 10, 2017, at the hour of 10:30 a.m. (Utah time) of said day, for the purpose of foreclosing that certain Trust Deed with Chad C Shattuck, a member of the Utah State Bar, as Successor Trustee under a Trust Deed, dated April 27, 2001, executed by Taylorsway, LLC., as Trustor(s), to Wayne H. Braunberger, as Trustee, in which Bradford E. Taylor is named as beneficiary, which Trust Deed was recorded December 27, 2002, as Entry No. 1817058:3195 p. 653, in the Records of the County Recorder of Davis County, State of Utah, and which covers the following-described real property situated in North Salt Lake, State of Utah, to wit:
Units 1 through 5 of Taylors Way Condominiums and common area. (Formerly part of Lot 4, Pinnacle Park Subdivision, North Salt Lake City, Davis County, Utah, according to the official plat thereof).
Davis County Land Serial Numbers: 01-411-0001, 01-411-0002, 01-411-0003, 01-411-0004,
01-411-0005, and 01-411-0007.
Units 1, 2, 3, 4 and 5, Taylor’s Way Condominiums, North Salt Lake City, Davis County, Utah, according to the official plat thereof, recorded February 29, 2008, in Book 4480, Page 3, as Entry No. 2345048 and as defined, and described in the Declaration recorded February 29, 2008, in Book 4480, Page 4, Entry No. 2345049 and any amendments thereto.
Together with: (a) the undivided ownership interest in said condominium project’s common areas and facilities which are appurtenant to said units (the referenced Declaration of Condominium providing for period alteration both in the magnitude of said undivided ownership interest and in the composition of the common areas and facilities to which said interest relates); (b) the exclusive right to use and enjoy each of the limited common areas which is appurtenant to said units; (c) the nonexclusive right to use and enjoy the common areas and facilities included in said condominium project (as said project may hereafter be expanded) in accordance with the aforesaid declaration and survey map (as said declaration and map may hereafter be amended or supplemented) and the Utah Condominium Ownership Act.

Hereby declare that a breach of an obligation for which the trust property was conveyed as security has occurred in that the principal and interest have not been paid, and said obligation has matured. To date, the Trustor has failed and neglected to pay $898,048.40, which Trustor is required to pay pursuant to the provisions of said Trust Deed. The Successor Trustee hereby declares that he elects to sell or cause to be sold all such property to satisfy the obligations secured thereby.
The Successor Trustee disclaims any responsibility for any error in the description of the physical address or legal description of the Property. The sale of the Property described herein will be made without any warranty, including warranties as to title, possession, encumbrances or bankruptcy status. Bidders must be prepared to tender $5,000.00 in certified funds at the sale and the balance of the purchase price in certified funds within twenty four (24) hours of the sale (unless the following day is a weekend or holiday in which case the balance must be tendered on the next business day following the day of the sale). The sale is also subject to workout, reinstatement, payoff, sale cancellation or postponement, incorrect bidding instructions, bankruptcy, or other circumstances of which the Trustee is unaware. In the event any of the foregoing applies, the sale will be void and the successful bidder’s funds will be returned without any liability to the Trustee or Beneficiary or interest or any other damages.
The current beneficiary of the Deed of Trust is Bradford E. Taylor and Taylorsway, LLC, is the record owner of the property as of the recording of the Notice of Default and Election to Sell.
The Successor Trustee under the Deed of Trust is Chad C Shattuck. The Successor Trustee’s mailing address and the address is 12401 South 450 East, Suite E-1, Draper, Utah 84020. The Successor Trustee can be contacted by telephone at (801) 748-4081 between the hours of 9:00 a.m. and 5:00 p.m. Monday through Friday, excluding holidays.
