1. Notice is hereby given that the above described defendant property was seized on or about the date and at the location indicated above, either by a peace officer incident to an arrest, or incident to the execution of a search warrant, or incident to the execution of a seizure warrant or with the consent of the person from whom seized, because the defendant property is contraband, or is a firearm, weapon or ammunition used or intended for use in violation of the Utah Controlled Substances Act, and/or it was carried or used in connection with such violation or was kept or located within the proximity of controlled substances, and/or it is property that was used or intended to be used to facilitate the distribution, or possession with intent to distribute, of controlled substances, and/or it was furnished or intended to be furnished in exchange for such controlled substances, and/or the defendant seized property is criminal proceeds traceable to any violation of the Utah Controlled Substances Act, and/or because it is property which is forfeitable under some other substantive provision of Utah law.
2. Notice is further given that plaintiff State of Utah intends to secure the forfeiture of the above defendant property, and to forfeit and transfer any right, title or interest that you may claim to have to said defendant property and in furtherance of this intent, has filed a civil, in rem Complaint for Forfeiture, pursuant to Utah Code Ann. Sec. 58-37-13(2), or other Utah law permitting such forfeiture, and to Sec. 24-1-1 et seq., seeking such forfeiture, with the above entitled Court.
3. Notice is hereby given pursuant to Utah Code Ann. Sec. 24-1-7, that you may be able to obtain release of the property by posting a surety bond or cash bond for the current fair market value of the property, and that you may also file a motion for a hardship release of the property. You should seek qualified legal advice regarding your possible rights to obtain possession of the seized property.
4. Notice is hereby given that pursuant to Utah Code Ann. Sec. 24-1-5, that you have thirty (30) days from the date of service of this Complaint upon you in which to file an Answer to the Complaint, which Complaint is on file with the Court herein, and a copy of which is herewith served upon you. Said Answer must be filed with the Clerk of the Third Judicial District Court, 450 South State, Salt Lake City, Utah 84111, and must also be mailed to, or served upon the Plaintiff’s attorney, Donald H. Hansen, Deputy District Attorney, at 2001 South State Street, Suite S3-600, Salt Lake City, UT 84190.
5. Notice is hereby given that if you fail to so answer, a default and judgment by default will be taken against you and you will forfeit any right, title or interest which you may claim in and to said defendant seized property.
