NOTICE OF TRUSTEE’S SALE
The following described real property will be sold at public auction to the highest bidder, purchase price payable in lawful money of the United States of America at the time of sale, at the west, main entrance of the Seventh Judicial District Courthouse, 297 South Main Street, Monticello, Utah on Monday, June 12, 2017, at the hour of 12:00 noon of that day for the purpose of foreclosing a deed of trust originally executed by First Street Car Wash, LLC, in favor of Wells Fargo Bank, National Association, covering real property located at approximately 465 North Main, Monticello, San Juan County, Utah, and more particularly described as:
PROPERTY LOCATED IN SAN JUAN, UT
THE FOLLOWING DESCRIBED TRACT OF LAND SITUATED IN SAN JUAN COUNTY, STATE OF UTAH, TO-WIT: BEGINNING AT THE SOUTHWEST CORNER OF THE NW 1/4 SE 1/4 OF SECTION 25, TOWNSHIP 33 SOUTH, RANGE 23 EAST, SLB&M; AND RUNNING THENCE EAST 858 FEET TO IRON PIPE ON THE WEST RIGHT OF WAY LINE OF HIGHWAY NO. 160; THENCE NORTH 0 DEGREES 06’ WEST ALONG SAID HIGHWAY LINE FOR A DISTANCE OF 980 FEET TO THE POINT OF BEGINNING; THENCE SOUTH 89 DEGREES 54’ WEST FOR A DISTANCE OF 135.45 FEET; THENCE NORTH 0 DEGREES 06’ WEST FOR A DISTANCE OF 75 FEET; THENCE NORTH 89 DEGREES 54’ EAST FOR A DISTANCE OF 135.45 FEET TO WEST’ RIGHT OF WAY LINE OF HIGHWAY NO. 160; THENCE SOUTH 0 DEGREES 06’ EAST ALONG SAID RIGHT OF WAY LINE A DISTANCE OF 75 FEET TO POINT OF BEGINNING.

AND BEING THE SAME PROPERTY CONVEYED TO FIRST STREET CAR WASH, LLC, A UTAH LIMITED LIABILITY COMPANY FROM SUPER SPLASH, INCORPORATED, A UTAH CORPORATION BY WARRANTY DEED DATED AS OF MARCH 3, 2004 AND RECORDED MARCH 3, 2004 IN DEED BOOK 824, PAGE 522. A33230258437
The current beneficiary of the trust deed is Wells Fargo Bank, National Association, and the record owner of the property as of the recording of the notice of default is First Street Car Wash, LLC, a Utah Limited Liability Company. The trustee’s sale of the aforedescribed real property will be made without warranty as to title, possession, or encumbrances. Bidders must be prepared to tender a cashier’s check in the amount of $20,000.00 at the sale. The balance of the purchase price must be paid by cashier’s check or wire transfer received by 12:00 noon the following business day. The trustee reserves the right to void the effect of the trustee’s sale after the sale based upon information unknown to the trustee at the time of the sale, such as a bankruptcy filing, a loan reinstatement, or an agreement between the trustor and beneficiary to postpone or cancel the sale. If so voided, the only recourse of the highest bidder is to receive a full refund of the money paid to the trustee. THIS IS AN ATTEMPT TO COLLECT A DEBT.
