The Beaver District Ranger of the Fishlake National Forest is proposing to implement a pit management plan for the North Fork of North Creek Mineral Material Pit (Pit). The existing Pit is approximately three miles due west of Mount Baldy along the North Fork of North Creek. It is in the SW ¼ of Section 1 T28S R5W SLBM.

The purpose of this proposal is to implement existing regulations related to the disposal of government owned mineral material or common variety minerals. In addition, the proposal will comply with the Fishlake National Forest Land and Resource Management Plan by allowing disposal of common variety mineral materials under terms and conditions to prevent, minimize, or mitigate adverse impacts on surface resources and uses.

The Beaver District has the need to authorize a pit management plan for the Pit that will define future development, production, and reclamation in order to respond to current and future requests for permits for common variety minerals from this Pit.

The proposed action is to authorize the Pit Management Plan. The plan outlines an open community pit less than ½ acre in size. Material from the Pit will be taken directly to point of sale or use. No processing of the rock will occur on site. Remaining rubble will be left in a 1:3 slope. Various environmental protection measures will be required including prevention of mined or eroded material entering into North Fork of North Creek.

During a preliminary assessment, Beaver District Ranger found this proposal lies within categories of actions listed in 36 CFR Part 220 (and Forest Service NEPA Handbook 1909.15) that can be excluded from documentation in an Environmental Assessment or Environmental Impact Statement, and that no know extraordinary circumstances exist that preclude exclusion. The proposed action is a routine activity as defined in FSH 1909.15 Section 32.2 and fits category 36 CFR 220.6(e)(3):“Approval, modification, or continuation of minor special uses of NFS lands that require less than five contiguous acres of land.”

Public Involvement - The USDA Forest Service (USFS) is no longer required to offer notice, comment, and appeal opportunities pursuant to 36 CFR 215 or 36 CFR 218 for categorically excluded projects. However, such legislative ruling does not limit the public’s ability to comment on USFS projects and activities.

By soliciting public comments the USFS ensures that a wide range of interests and perspectives are considered and that site specific natural resource concerns are identified and meeting the NEPA requirements for public scoping with an opportunity to comment prior to a decision by the responsible official.

Comment Process - Please submit your detailed project specific comments within 14 days of this publication in the Beaver County Journal. Comments received, including names and addresses of those who comment, will be considered part of the public record for this project, and may be made available for public inspection.
