NOTICE OF TRUSTEE'S SALE

The following described property will be sold at public auction to the highest bidder at the Main Entrance, Second Judicial District Courthouse, 800 West State Street, Farmington, Utah, on May 23, 2017, at 9:30 am, for the purpose of foreclosing a deed of trust dated July 30, 2007 and executed by Beverly Buckway Rosales and Ricardo Rosales, as trustors, in favor of Mortgage Electronic Registration Systems, Inc., as nominee for Countrywide Home Loans, Inc. dba America's Wholesale Lender, its successors and assigns, covering the following real property purported to be located in Davis County at 791 East San Simeon Way, Bountiful, UT 84010 (the undersigned disclaims liability for any error in the address), and more particularly described as:
All of Lot 39, SAN SIMEON HILLS SUBDIVISION PLAT C, according to the official plat thereof, on file and of record in the office of the Davis County Recorder.
Together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. Parcel No.: 05-049-0039
The current beneficiary of the deed of trust is The Bank of New York Mellon, f/k/a The Bank of New York, as trustee for the certificateholders of the CWABS, Inc., Asset-Backed Certificates, Series 2007-12 and the record owner of the property as of the recording of the notice of default is Sterling Fiduciaries, LLC, Trustee of the Calidez Holdings Trust dated the 16th day of February, 2012.
The sale is subject to bankruptcy filing, payoff, reinstatement or other circumstance that affects the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder's funds returned, and the trustee and current beneficiary shall not be liable to the successful bidder for any damage.
A $20,000.00 deposit in the form of a bank or credit union cashier's check or a bank official check, payable to eTitle Insurance Agency, is required to bid. A successful bidder who fails to tender the full purchase price will forfeit the entire deposit. The successful bidder must tender the deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The balance must be in the form of a wire transfer, bank or credit union cashier's check, or bank official check payable to eTitle Insurance Agency. A bank or credit union cashier's check must be pre-printed and clearly state that it is a cashier's check. A bank official check must be pre-printed and clearly state that it is an official check. Cash payments are not accepted. A trustee's deed will be delivered to the successful bidder within five business days after receipt of the amount bid.
