NOTICE OF TRUSTEE’S SALE
The following described real property will be sold at public auction to the highest bidder, purchase price payable in lawful money of the United States of America at the time of sale, at the main entrance of the Sanpete County Courthouse, 160 North Main Street, Manti, UT 84642, on the 18th day of May, 2017, at 10:00 o’clock a.m., of that day for the purpose of foreclosing a deed of trust originally executed by Erik Peterson and Rebecca Peterson, in favor of The Craig M. Peterson & Tamara A. Peterson Family Trust, covering real property commonly known and numbered as HC 13 Box 4420, Fairview, UT 84629, and more particularly described as follows in the records of Sanpete County, State of Utah:
LOT 13, PLAT “B”, HIDEAWAY VALLEY SUBDIVISION, ACCORDING TO THE OFFICIAL PLAT THEREOF ON FILE AND OF RECORD IN THE SANPETE COUNTY RECORDER’S OFFICE. (40071)
SUBJECT TO EASEMENTS, COVENANTS, CONDITIONS, RESTRICTIONS, RIGHTS OF WAY AND PRIOR RESERVATIONS OF MINERALS APPEARING OF RECORD, OR ANY OTHER RESERVATIONS OF RECORD.
TOGETHER WITH AND SUBJECT TO A RIGHT-OF-WAY OVER AND ACROSS THE PRIVATE ROADS WITHIN SAID SUBDIVISION AS SHOWN ON THE RECORDED PLAT THEREOF.
EXCEPTING THEREFROM ALL OIL, GAS, HYDROCARBONS AND/OR OTHER MINERALS IN, ON OR UNDER SAID LAND, TOGETHER WITH THE RIGHT OF INGRESS AND EGRESS FOR THE PURPOSE OF EXPLORING AND/OR REMOVING THE SAME.
`The trustee’s sale of the afore described real property will be made without warranty as to title, possession, or encumbrances. Bidders must be prepared to tender a cashier’s check in the amount of $5,000.00 at the sale. The balance of the purchase price must be paid by cashier’s check or wire transfer received by 12:00 noon the following business day. The trustee reserves the right to void the effect of the trustee’s sale after the sale based upon information unknown to the trustee at the time of the sale, such as a bankruptcy filing, a loan reinstatement, or an agreement between the trustor and beneficiary to postpone or cancel the sale. If so voided, the only recourse of the highest bidder is to receive a full refund of the money paid to the trustee.
