NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST THE RELEASE OF FUNDS March 17, 2017 State of Utah Department of Workforce Services Housing & Community Development Division 1385 South State, 4th Floor Salt Lake City, UT 84115 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by Rural Housing Development Corporation DBA Self-Help Homes REQUEST FOR THE RELEASE OF FUNDS On or about April 4, 2017 the State of Utah, Department of Workforce Services, Housing & Community Development Division (HCDD) will submit a request to the U.S. Department of Housing and Urban Development for the release of HOME funds under Title Il Section 288 of the Cranston- Gonzalez National Affordable Housing Act (NAHA) as amended and will also direct that the Housing Assistance Council (HAC) request the release of Self-Help Home Opportunity Program (SHOP/HLP) funds authorized by Section 11 of the Housing Opportunity Program Extension Act of 1996 (P.L. 104-120) to undertake the project known as Riverwoods for the purpose of the construction of up to Four residential homes through the Mutual Self-Help Housing program located in 835 N 370 W and other individual lots located between 900 N to 800 N and 370 W and Hwy 17, LaVerkin, Utah 84745. The project will be carried out by Rural Housing Development Corporation DBA Self-Help Homes. The total estimated cost of the project is $2,200,000. FINDING OF NO SIGNIFICANT IMPACT An environmental review for the project has been made by HCDD and is available for public examination and copying at State of Utah, Department of Workforce Services, Housing & Community Development Division, 1385 South State, 4th Floor, Salt Lake City, Utah, Monday - Thursday between the hours of 8 A.M and 5 P.M. Based on this review, HCDD has determined that the project will have no significant impact on the human environment and hence an environmental impact statement will not be undertaken under the National Environmental Policy Act of 1969 (NEPA). PUBLIC COMMENTS ON FINDING All interested agencies, groups and persons disagreeing with this determination are invited to submit written comments to State of Utah, Department of Workforce Services, Housing & Community Development Division, Attn: Cheryl Brown, 1385 South State, 4th Floor, Salt Lake City, UT 84115 by April 3, 2017. All comments should specify which Notice they are addressing. RELEASE OF FUNDS HCDD is certifying to HUD that Jonathan Hardy, HCDD Director, in his official capacity, consents to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities in relation to environmental reviews, decision making, and action; and that these responsibilities have been satisfied. The legal effect of the certification is that upon its approval, Rural Housing Development Corporation DBA Self-Help Homes and HAC may use HOME and SHOP/HLP funds and HCDD will have satisfied its responsibilities under the National Environmental Policy Act of 1969 and other environmental responsibilities listed in 24 CFR Part 58. OBJECTIONS TO HUD RELEASE OF FUNDS HUD will accept objections to its release of funds and HCDD's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is late) only if they are made on one of the following bases: (a) the certification was not executed by the Certifying Officer of HCDD : (b) HCDD has omitted a step or failed to make a decision or finding required by U.S. Department of Housing and Urban Development regulations at 24 CFR Part 58; (c) Rural Housing Development Corporation DBA Self-Help Homes has committed funds or incurred costs not authorized by 24 CFR Part 58 before the approval of a release of funds by the U.S. Department of Housing and Urban Development or (d) another Federal agency, acting pursuant to 40 CFR part 1504, has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures of 24 CFR Part 58 and shall be addressed to Cheryl Brown, State of Utah, Department of Workforce Services, Housing & Community Development Divsion, 1385 South State, 4th Floor, Salt Lake City, Utah 84115 and HUD at Phillip McKeough, CPD Representative, 1670 Broadway, Denver, CO 80202.
