NOTICE OF TRUSTEE’S SALE
The following described real property will be sold at public auction to the highest bidder, purchase price payable in lawful money of the United States of America at the time of sale, in the lobby at the west main entrance of the Sixth Judicial District Court, 160 North Main, Manti, Utah, on Tuesday, March 27, 2012, at the hour of 9:00 a.m. of that day for the purpose of foreclosing a deed of trust originally executed by Thomas L. Clark and Patricia H. Clark, in favor of Mortgage Electronic Registration Systems, Inc., covering real property located at approximately 404 South 500 West, Manti, Sanpete County, Utah, and more particularly described as:
BEGINNING AT THE NORTHEAST CORNER OF LOT 4, BLOCK 11, PLAT “A”, MANTI CITY SURVEY; THENCE SOUTH 214.50 FEET; THENCE WEST 210.00 FEET; THENCE NORTH 214.50 FEET; THENCE EAST 210.00 FEET TO THE POINT OF BEGINNING. 1143X3
The current beneficiary of the trust deed is Bank of America, National Association as successor by merger to LaSalle Bank National Association, as Trustee for Certificateholders of Bear Stearns Asset Backed Securities I LLC, Asset-Backed Certificates, Series 2007-HE5, and the record owner of the property as of the recording of the notice of default is Thomas L. Clark and Patricia H. Clark. The trustee’s sale of the aforedescribed real property will be made without warranty as to title, possession, or encumbrances. Bidders must be prepared to tender $5,000.00 in certified funds at the sale and the balance of the purchase price in certified funds by 10:00 a.m. the following business day. The trustee reserves the right to void the effect of the trustee’s sale after the sale based upon information unknown to the trustee at the time of the sale, such as a bankruptcy filing, a loan reinstatement, or an agreement between the trustor and beneficiary to postpone or cancel the sale. If so voided, the only recourse of the highest bidder is to receive a full refund of the money paid to the trustee. THIS IS AN ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
