NOTICE OF TRUSTEE’S SALE
The following described property will be sold at public auction to the highest bidder, payable in lawful money of the United States at the West Foyer – Manti Courthouse, located at 160 North Main Manti, UT 84642 on March 23 2012, at 1:30p.m. of said day, for the purpose of foreclosing a Deed of Trust Assignment of Rents and Security Agreement originally executed by John E. Westenskow and Adrienne Westenskow as Trustor, in favor of First American Title as Trustee, for the benefit of Travelers Bank & Trust, FSB as Beneficiary, recorded December 3, 2001 as Entry No. 090629 in Book 0462 at Page 2568 of the Records of the County Recorder of Sanpete County, State of Utah (the “Deed of Trust”), more particularly described as:
The North Half of Lot 1, Block 16, Plat “B”, Moroni City Survey
The current beneficiary of said Deed of Trust is Newbury Place REO II, LLC, and the record owners of the real property as of the recording of the Notice of Default are John E. Westenskow and Adrienne Westenskow
Bidders (except the Beneficiary, which may credit bid) must tender to the Trustee a $5,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a bank cashier’s payable to Metro National Title Company, Trustee. The balance must be in the form of a wire transfer, or bank cashier’s check, payable to Metro National Title Company, Trustee. Cash payments are not acceptable. A trustee’s deed will be delivered to the successful bidder within three business days after receipt of the amount bid.
The sale is made without any warranty whatsoever, including but not limited to any warranty as to title, liens, possession, taxes, encumbrances, or condition of the property. The sale is subject to a workout reinstatement, payoff, sale cancellation or postponement, incorrect bidding instructions, bankruptcy, or any other circumstance of which the Trustee is unaware. In the event any of the foregoing apply, the sale will be void and the successful bidder’s funds will be returned without any liability to the trustee or beneficiary for interest or any other damages.
