The following described property will be sold at public auction to the highest bidder in the Main Entrance of the Wasatch County Courthouse, 1361 South Highway 40, Heber City, UT 84032, on March 20, 2012, at 2:00 p.m. of said day, for the purpose of foreclosing a trust deed dated March 23, 2011 (the “Trust Deed”) executed by LORENCE HARMER, as Trustor, in favor of ZAGG INCORPORATED, as Beneficiary, and covering real property located at approximately 503 North Trappers Loop Road, Heber City, UT 84032 (the address is given for informational purposes only and the undersigned disclaims any liability for an error in said address), and more fully described as follows:
ALL OF LOT 63, WOLF CREEK PLAT 4-C, ACCORDING TO THE OFFICIAL PLAT THEREOF ON FILE AND OF RECORD IN THE WASATCH COUNTY RECORDER’S OFFICE
together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. The current beneficiary of the trust deed is Zagg Incorporated, a Nevada corporation. The record owner of the property is Lorence A. Harmer. The Trust Deed was recorded in the office of the Wasatch County Recorder, Utah, on March 25, 2011, in Book 1032, at Page 1279, as Entry Number 367919. Said sale will be made without covenant or warranty of any kind, whether express or implied, including without limitation warranties of title, possession, condition or encumbrances. The sale is subject to bankruptcy filing, payoff of the underlying indebtedness, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstances exist, the sale shall be void, the successful bidder’s funds returned and the trustee and beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $5,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a cashier’s check or bank official check payable to the trustee and beneficiary of the Trust Deed. The balance must be in the form of a wire transfer, cashier’s check, or bank official check payable to “Durham Jones & Pinegar, P.C.” Cash payments are not accepted.
