NOTICE OF TRUSTEE'S SALE

The following-described property will be sold at public auction to the highest bidder, payable in lawful money of the United States at the time of the sale, at the Main Entrance, Wasatch County Courthouse, 1361 S. Highway 40, Heber City, Utah, on Friday, March 23, 2012, at 1:00 p.m. of said day, for the purpose of foreclosing a trust deed dated October 11, 2005 and executed by TRACY ROTH, as Trustor in favor of FRONTIER BANK, FSB as Beneficiary, and MATTHEW B. HUTCHINSON, an active member of the Utah State Bar, as the Successor Trustee. The Trust Deed was recorded on October 13, 2005 as Entry No. 290353 in the Office of the Wasatch County Recorder and covers the following parcel of real property located in Wasatch County at 9188 North Uinta Circle, Heber City, Utah, and is more particularly described as:
LOT 40, TUHAYE SUBDIVISION PHASE I, SECOND AMENDED, ACCORDING TO THE OFFICIAL PLAT THEREOF ON FILE AND OF RECORD IN THE WASATCH COUNTY RECORDER’S OFFICE.
TOGETHER WITH THAT CERTAIN “EASEMENT AGREEMENT FOR ROADWAY AND UTILITIES”, RECORDED ON APRIL 29, 2002 AS ENTRY NO. 244333, IN BOOK 557, AT PAGE 369 IN THE OFFICE OF THE WASATCH COUNTY RECORDER.

The undersigned disclaims any liability for any error in the street address or tax identification numbers set forth above. The Notice of Default for the Trust Deed was recorded on November 14, 2011 as Entry No. 373945, in the Office of the Wasatch County Recorder. The current Beneficiary of the trust deed is FRONTIER BANK, FSB, and the record owner of the property as of the recording of the notice of default is reported to be TRACY ALAN DEVELOPMENT & CONSTRUCTION CORP., an expired Utah corporation.
Bidders must be prepared to tender to the duly appointed successor trustee, MATTHEW B. HUTCHINSON, an active member of the Utah State Bar, $5,000.00 at the sale and the balance of the purchase price by 12:00 noon the first business day following the sale and deliverable to: Hutchinson Law P.C. 2700 Homestead Road, Suite 1600, Park City UT 84098. Both payments must be in the form of a cashier\'s check or money order and made payable to FRONTIER BANK, FSB. Cash and Bank “Official Checks” are not acceptable. A trustee\'s deed will be made available to the successful bidder within three business days following receipt of the bid amount. The sale is made without any warranty whatsoever, including but not limited to any warranty as to title, liens, possession, taxes, encumbrances, or condition of the property. The sale is subject to a workout reinstatement, payoff, sale cancellation or postponement, incorrect bidding instructions, bankruptcy, or any other circumstance of which the trustee is unaware. In the event any of the foregoing applies, the sale will be void and the successful bidder\'s funds will be returned without any liability to the trustee or beneficiary for interest or any other damages.
