NOTICE OF TRUSTEE’S SALE

The following described property will be sold at public auction to the highest bidder, without warranty as to title, possession, liens or encumbrances, payable in lawful money of the United States, at the main entrance of the Fourth Judicial District Courthouse, 1361 S. Hwy 40, Heber City, Utah, on Monday, March 19, 2012, at 11:00 a.m., for the purpose of foreclosing a Deed of Trust dated January 17, 2008, executed by DANIEL K. ALLEN and DAVID M. ROGERS, Joint Tenants, as Trustor, in favor of ZIONS FIRST NATIONAL BANK, as Beneficiary, covering real property located in Wasatch County, State of Utah, and more particularly described as follows:
Lot 47, Tuhaye Subdivision Phase I, Second Amended, according to the official plat thereof on file and of record in the Wasatch County Recorder’s Office. Together with that certain Easement Agreement for Roadway and Utilities, recorded on April 29, 2002 as Entry No. 244333, in Book 557, at page 369 in the office of the Wasatch County Recorder.

TOGETHER WITH all existing or subsequently erected or affixed buildings, improvements and fixtures; all easements, rights of way, and appurtenances; all water, water rights and ditch rights (including stock in utilities with ditch or irrigation rights); and all other rights, royalties, and profits relating to the real property, including without limitation all minerals, oil, gas, geothermal and similar matters.
The street address of the property is purported to be 9367 North Uinta Drive, Heber City, Utah 84032. The undersigned disclaims any liability for any error in the street address.
The current Beneficiary of the Deed of Trust is ZIONS FIRST NATIONAL BANK and the record owner of the property as of the recording of the Notice of Default is reported to be DANIEL K. ALLEN and DAVID M. ROGERS, as Joint Tenants.
Bidders must be prepared to tender to the Successor Trustee a $5,000.00 deposit at the time of the sale with the balance delivered by 12:00 noon the following business day to Trustee’s office located at 15 West South Temple, Suite 1700, Salt Lake City, Utah 84101. The deposit must be in the form of a cashier’s check, bank official check, or U.S. Postal money order, payable to Prince, Yeates & Geldzahler. The balance must be in the form of a cashier’s check, bank official check, U.S. Postal money order, or by wire transfer, payable to Prince, Yeates & Geldzahler.
In addition, Beneficiary may, pursuant to the Utah Commercial Code, cause any personal property described in the Deed in which Beneficiary was granted a lien, to be sold in connection with the real property.
