NOTICE OF TRUSTEE\'S SALE
The following described real property will be sold at public auction to the highest bidder, purchase price payable in lawful money of the United States of America at the time of sale, 111 at the east (main) entrance of the Cache County Courthouse, a/k/a First Judicial District, 135 North 100 West, Logan, Utah, on Wednesday, March 21, 2012, at the hour of 4:00 p.m. of that day for the purpose of foreclosing a deed of trust originally executed by Mountainland Developers LLC, a Utah limited liability company, in favor of America West Bank, covering real property located at approximately 1650 North 400 West, North Logan, Cache County, Utah, (vacant land) and more particularly described as:
PARCEL 1: BEGINNING 10.5 RODS NORTH OF THE SOUTHEAST CORNER OF LOT 7, BLOCK 6, PLAT \"D\", LOGAN FARM SURVEY; THENCE WEST TO THE EAST LINE OF OSL-RAILROAD RIGHT-OF-WAY; THENCE NORTH 10.5 RODS ALONG SAID RIGHT-OF-WAY; THENCE EAST TO A POINT NORTH OF BEGINNING; THENCE SOUTH 10.5 RODS TO THE BEGINNING.
PARCEL 2: BEGINNING AT THE SOUTHEAST CORNER OF LOT 7, BLOCK 6, PLAT \"D\", LOGAN FARM SURVEY; THENCE WEST TO THE EAST LINE OF OSL-RAILROAD RIGHT-OF-WAY; THENCE NORTHERLY ALONG SAID RIGHT-OF-WAY 10.5 RODS; THENCE EAST TO A POINT NORTH OF BEGINNING; THENCE SOUTH 10.5 RODS TO BEGINNING. 04-081-0014 and 04-081-0015
The current beneficiary of the trust deed is 2010-1 RADC/CADC Venture, LLC, a Delaware limited liability company, and the record owner of the property as of the recording of the notice of default is Mountainland Developers LLC. The trustee\'s sale of the aforedescribed real property will be made without warranty as to title, possession, or encumbrances. Bidders must be prepared to tender $5,000.00 in certified funds at the sale and the balance of the purchase price in certified funds by 10:00 a.m. the following business day. The trustee reserves the right to void the effect of the trustee\'s sale after the sale based upon information unknown to the trustee at the time of the sale, such as a bankruptcy filing, a loan reinstatement, or an agreement between the trustor and beneficiary to postpone or cancel the sale. If so voided, the only recourse of the highest bidder is to receive a full refund of the money paid to the trustee. THIS IS AN ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
