NOTICE OF TRUSTEE 'S SALE The following described property will be sold at public auction to the highest bidder at the Main Entrance, Farmington District Court, 800 West State Street, Farmington, UT, on March 13, 2012, at 9:30 a.m. of said day, for the purpose of foreclosing a trust deed originally executed on September 25, 2006 by Larry M. Roberts and Margaret A. Roberts, as trustors, in favor of Mortgage Electronic Registration Systems, Inc., as nominee for First Franklin a Division of National City Bank, its successors and assigns, covering the following real property purported to be located in Davis County at 865 South 1650 East, Unit B, Clearfield, UT 84015 (the undersigned disclaims liability for any error in the address), and more particularly described as: Unit "B ", in Building 21, contained within THE SUNDOWNER CONDOMINIUM PHASE 3, A Condominium Project as the same is identified in the Record of Survey Map recorded in Davis County, as Entry No. 390624 and 420453, in Book 579, at Page 512 (as said Record of Survey Map may have heretofore been amended or supplemented) and in the Declaration recorded in Davis County, as Entry No. 435718 in Book 604 at Page 765 (as said Declaration may have heretofore been amended or supplemented.) Roberts and Margaret A. Roberts. The sale is subject to bankruptcy filing, payoff, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder 's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $20,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a bank or credit union cashier 's check or bank official check payable to eTitle Insurance Agency.
