NOTICE OF TRUSTEE’S SALE
IMPORTANT NOTICE TO PROPERTY OWNER: YOU ARE IN DEFAULT UNDER A DEED OF TRUST DATED JULY 10, 2008. UNLESS YOU TAKE ACTION TO PROTECT THE PROPERTY, IT MAY BE SOLD AT A PUBLIC SALE. IF YOU NEED AN EXPLANATION OF THE PROCEEDING, YOU SHOULD CONTACT A LAWYER.
The following described property will be sold at public auction to the highest bidder, payable in lawful money of the United States at the time of sale. The foreclosure sale through public auction will be held on the front entrance of the Box Elder County in Brigham City located at 43 North Main, Brigham City, Utah on Thursday, March 22, 2012 at 9:00 a.m. This sale is being held for the purpose of foreclosing a Deed of Trust originally executed by Pointe Perry, L.C. the Trustor, in favor of Proficio Bank, covering real property located in Box Elder County, State of Utah, and more particularly described as:

The current beneficiary of the Deed of Trust, Security Agreement and Assignment of Leases and Rent is Proficio Bank, the record owner of the property as of the recording of the Notice of Default is Pointe Perry, L.C. The successful bidder must tender to the trustee a $25,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon on Friday, March 23, 2012 in the Trustee’s Salt Lake office. Both the deposit and the balance must be in the form of a wire transfer, cashier’s check or certified funds payable to Richards, Brandt, Miller Nelson. Cash payments will not be accepted. A trustee’s deed will be delivered to the successful bidder within three business days after receipt of the amount bid.
The undersigned Trustee disclaims any liability for any incorrectness of the street address and other common designation, if any, shown herein. Said sale will be made without covenant or warranty, express or implied, regarding title, possession, condition or encumbrances, including fees, charges and expenses of the Trustee and of the trusts created by said Deed of Trust, to pay the remaining principal sums of the note(s) secured by said Deed of Trust.
