NOTICE OF TRUSTEE\'S SALE

The following described real property will be sold at public auction to the highest bidder, purchase price payable in lawful money of the United States of America at the time of sale, 111 at the east (main) entrance of the Cache County Courthouse, a/k/a First Judicial District, 135 North 100 West, Logan, Utah, on Tuesday, March 13, 2012, at the hour of 3:00 p.m. of that day for the purpose of foreclosing a deed of trust originally executed by Martin A. Tayon and Cindy L. Tayon, in favor of Washington Mutual Bank, FA, covering real property located at approximately 11087 South 800 East, Avon, Cache County, Utah, and more particularly described as:

BEGINNING 37 LINKS WEST AND 210 FEET SOUTH OF THE SOUTHEAST CORNER OF THE NORTHEAST QUARTER, SECTION 10, TOWNSHIP 9 NORTH, RANGE 1 EAST AND THENCE SOUTH 165 FEET; THENCE WEST 264 FEET; THENCE NORTH 289 FEET; THENCE EAST 264 FEET; THENCE SOUTH 124 FEET TO THE POINT OF BEGINNING. TOGETHER WITH ALL RIGHT, TITLE AND INTEREST IN AND TO WATER RIGHT NO. 25-9423 AS FILED WITH THE UTAH STATE DIVISION OF WATER RIGHTS. BEING THE SAME PROPERTY AS CONVEYED TO MARTIN A. TAYON AND CINDY L. TAYON BY DEED RECORDED 05/21/03 IN BOOK 1229, PAGE 1635.

The current beneficiary of the trust deed is JPMorgan Chase Bank, National Association, and the record owner of the property as of the recording of the notice of default is Martin A. Tayon and Cindy L. Tayon, or their Successors, as Trustees of the Martin A. Tayon and Cindy L. Tayon Revocable Trust dated June 28, 2010. The trustee\'s sale of the aforedescribed real property will be made without warranty as to title, possession, or encumbrances. Bidders must be prepared to tender $5,000.00 in certified funds at the sale and the balance of the purchase price in certified funds by 10:00 a.m. the following business day. The trustee reserves the right to void the effect of the trustee\'s sale after the sale based upon information unknown to the trustee at the time of the sale, such as a bankruptcy filing, a loan reinstatement, or an agreement between the trustor and beneficiary to postpone or cancel the sale. If so voided, the only recourse of the highest bidder is to receive a full refund of the money paid to the trustee. THIS IS AN ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
